Yanku — Recurring Payment Terms

Scope
These Recurring Payment Terms govern automatic recurring (subscription) charges made through the Yanku platform. They are additional terms that supplement the Yanku Terms of Service, the Terms of Sale between the Member and the Facility, and the Privacy Policy. By activating a Recurring Purchase, you accept these terms in addition to the others.
These terms describe how recurring charges work on Yanku. What you receive — the product, the price, the Billing Cycle, the access period, partial-period refund eligibility — is set by the Facility and described in the Facility's Terms of Sale and any policies the Facility has published on Yanku, which are shown to you at checkout.
These terms apply identically regardless of which Facility you subscribe to. Yanku does not publish per-facility variants of these recurring payment terms — the payment mechanism is the same across the Platform.
1. Definitions
Capitalised terms used here have the meanings given in the Yanku Terms of Service. Additionally:
"Recurring Purchase" — a purchase under which you authorise Yanku and the Payment Processor to charge your Saved Card automatically on a defined schedule (for example, a monthly membership, a periodic pass renewal).
"Payment Processor" — Maksekeskus AS, registered in the Republic of Estonia.
"Saved Card" — a payment card you have authorised the Payment Processor to retain on file in tokenised form for future charges.
"Billing Cycle" — the recurring interval shown at checkout (for example, every 30 days, monthly on a fixed date, or every 12 months).
"Seller Payout Method" — the Payment Processor service that, on each successful charge, routes the Transaction Fee to Yanku and the remainder to the Facility.
2. How recurring payments work
2.1 Authorisation
When you complete a Recurring Purchase, you authorise Yanku — acting as the Facility's payment-collection agent — together with the Payment Processor to charge your Saved Card on the Billing Cycle and for the amount shown at checkout, without further action from you, until the Recurring Purchase is cancelled in accordance with §5.
2.2 Card storage
Your card details are tokenised and stored by the Payment Processor (Maksekeskus AS) in a PCI DSS–compliant environment. Yanku does not receive, process, or store your full card number, expiry date, or CVC. Yanku retains only partial card metadata returned by the Payment Processor — the last four digits, card brand, and country — so you can identify the card in your account.
You may save a card to your Yanku account and use it for purchases at any Facility you choose. Saving a card does not by itself authorise any charge; each Recurring Purchase is a separate authorisation tied to one Facility and one product. Saving a card for one Facility does not authorise other Facilities to charge it.
2.3 Amount charged
The amount charged on each Billing Cycle equals the price of the Facility's subscription product at the time of the charge.
If the Facility changes the price of the product, you will be notified by email at least 30 days before the new price takes effect. You may cancel the Recurring Purchase at any time before the new price applies (see §5). Continuing the subscription after the notice period constitutes acceptance of the new price.
2.4 Receipts
You receive an email receipt for every successful charge, identifying the Facility, the product, the amount, the date, and the last four digits of the Saved Card used.
2.5 Funds settlement
For each successful charge, the Payment Processor splits the funds using the Seller Payout Method: Yanku's Transaction Fee is routed to Yanku's account and the remainder is paid to the Facility's account on the schedule the Facility has configured. As the Member, you are not involved in this split — your obligation is the single charge shown on your card statement.
3. Saved cards across facilities
Cards saved in your Yanku account may be reused, at your choice, for purchases and Recurring Purchases at any Facility on Yanku. The Facility does not receive your full card number; it sees only that a card was used and the partial metadata listed in §2.2.
You can view your Saved Cards and remove any of them at any time from your Yanku account. Removing a Saved Card stops it being used for any future charge. If the removed card is the payment method for one or more active Recurring Purchases, those Recurring Purchases must first be moved to another Saved Card or cancelled; we will tell you which active Recurring Purchases are affected before removal is permitted.
4. Failed payments
4.1 What counts as a failure
A charge is considered failed where the Payment Processor reports any of the following: insufficient funds, expired card, card revoked or blocked, transaction declined by the issuing bank, or any other authorisation failure outside Yanku's control.
4.2 Retry policy
If a scheduled charge fails, Yanku will:
notify you by email without undue delay;
automatically retry the charge over the following days;
give you the opportunity to update the Saved Card from your Yanku account.
The exact retry schedule may change over time to reflect issuer best practice. If all retry attempts fail, the Recurring Purchase may be suspended or cancelled in line with the Facility's own terms, and access to the subscribed product will end in accordance with §5 and the Facility's terms.
4.3 Restoring a Recurring Purchase
You can restore a suspended Recurring Purchase at any time by updating your payment method in your Yanku account. The Facility may separately require you to settle any outstanding amount before reinstating access.
5. Cancellation
5.1 How to cancel
You may cancel any Recurring Purchase at any time, free of charge, directly from your Yanku account. No email, telephone call, or contact with the Facility is required.
5.2 Effect of cancellation
Cancellation stops all future charges with immediate effect.
You retain access to the subscribed product until the end of the Billing Cycle you have already paid for. The Facility may, in its own terms, provide more generous treatment (such as continued access beyond that period); the Facility's terms cannot override your right to cancel future charges at any time.
Yanku does not issue refunds for partially used Billing Cycles. Refund eligibility, if any, for unused periods is governed by the Facility's refund policy and applicable consumer-protection law.
5.3 Statutory withdrawal rights
Nothing in these terms removes statutory consumer rights that apply to your purchase, including the right of withdrawal under EU Directive 2011/83/EU where it applies. Where a Recurring Purchase is for a service that has already begun being performed at your express prior request, the right of withdrawal may be limited in accordance with that Directive.
6. Disputes
6.1 Where to direct disputes
For issues with how a charge was made — a wrong amount, a duplicate charge, a charge after cancellation, or a charge you do not recognise — contact Yanku at info@yanku.eu. These are Yanku's responsibility.
For issues with the product itself — access not being granted, the service not matching its description, or other quality issues — contact the Facility using the contact details shown on the product or order page. The legal contract for the underlying purchase is between you and the Facility (see Yanku Terms of Service §3.5 and §4.5).
6.2 Chargebacks
If you initiate a chargeback with your card issuer in respect of a charge validly authorised under these terms, Yanku and the Facility may submit evidence of authorisation, delivery, and cancellation status to the Payment Processor and the issuing bank. Unjustified chargebacks may also be recovered from you to the extent permitted by law.
6.3 Out-of-court dispute resolution
You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr and the Estonian Consumer Disputes Committee where the dispute concerns an Estonian Facility.
7. Changes to these terms
Yanku may update these Recurring Payment Terms from time to time. For changes that materially affect your ongoing recurring authorisation — for example changes to the retry policy, the cancellation flow, or the allocation of dispute responsibility — we will notify active subscribers by email at least 30 days before the change takes effect.
If you do not accept a change, you may cancel any affected Recurring Purchase before the new terms apply, at no additional cost. Continuing a Recurring Purchase after the new terms take effect constitutes acceptance.
